Should apply for H1 extension or stay on EAD? Gurus.. please help.

Hi,

My H1 6 year limit is near end on Nov. 03. I have Sub. labor, approved I140, EAD and AP. EAD will be ending in Mar 04.

RD 10/18/02
ND 01/11/02

I140 AD 02/24/03
EAD/AP AD 03/07/03

My question is, should I apply for H1 extension or should I say on EAD? What are the odds in both cases?


I am also thinkinging about changing jobs.... lot of people on this forum been in this situation... any suggestion gurus?
 
It is better to renew H1B. I renewed my H1B twice after the 6 year limit.

BTW, I used to follow your case and wang's case closely, since my I-140/I-485 RD and ND was around the same date as yours, also I got RFE for I-140 and then EAD and AP approved after I-140 approval.

H1-B if it is ok

Yes, it's better for you to stay on H1-B, if you can not have both, and have to choose betwen the two.

But as far as I know, employers tend to ask you to use EAD, because it is cheaper for them. They pay a fee to sponsor someone on H1-B.

BTW, I vote for h1 extension, becuase it seems to be safer. But have both extended if you can.

I vote for EAD. It's a no hassle business. Many people prefer H1 because they think that they can still stay in this country even if GC is rejected. I am not sure of it, it depends on the grounds on which GC is rejected. I don't care about this advantage because the percentage of people getting rejection is < 0.01% .

BTW, please modify the ND in your signature. It says "1/11/02" instead of "11/1/02". My RD/ND and your's are almost same. Let's
keep in touch here(including Edison)
It's going to be long journey for us. :p :p
