Hello to all the experienced ones...

Does having a background in environmental engg with about 2 years work experience with MS and BS in the same field help in anyway at all during the LC process, particularly in NY?

Also, does working for federal and state clients give me a shot for NIW? Any suggestions/ideas are greatly appreciated.
Thanks in advance.

To answer your question, yes, having a master's degree and experience helps in your LC process, assuming, your salary is in par with the Labor dept. expectations.

Working with the state and federal clients does help you in your NIW process but individually you also need to have papers published, won awards (national or international caliber) in the area of your expertise, and ofcourse, letters about your contribution to the field from people renowned in the field. There are other intangibles that could add to your NIW process. Contact an attorney who specializes in NIW (e.g. Law Office of Sheela Murthy, etc.) and obtain their opinion on your case.

Good Luck!

I agree with vvee

but one could b working for the govt just as a contractor or on grants. this satisfies one aspect of NIW. the other most important aspects are an individual's past track record of publications, research work and impact on the field. also you would need to show as to why requirement of labor certification in your case would be adverse. You would also need letters from renowned professors/scientists in the filed who can attest to your qualifications. If you have the above points in hand..then you can have a shot. Also, in the meantime ask your company to file labor certification for you if they are willing to do it.

Hi vvee and ag28,
Thanks very much for your replies.
In my 2 yrs of experience I just have one paper published and that too I am not the main author, but a co-author.
But I know for a fact that the projects I have worked on have a very significant impact in the state. So having one paper to my name (in addition to MS degree) and 2-3 letters from the agencies that I have been associated with, do you think its worth a shot? Also I read somewhere that NIW and RIR LC can be filed simultaneously, so that in case NIW backfires, then atleast the time spent would not go waste since the RIR would be in progress at the same time to fall abck upon. Any thoughts on that?
Thanks again.

can file both at same time

this is what i found after browsing through this site. but in the current situation, i dont know if RiR would work. anyway..could you get letters from people who can testify that your work is in the national interest and has had a significant impact in the field. the stipulations for niw do not want just a perceived benefit but also something tangible that has already been done by you before (like something in your MS work).
Maybe..you can send private msg for more discussion because people on this board might want to see general replies rather than something very specific.
