Shoplifting and Green Card

Hi,

I was once charged with petit larceny for shoplifting a mere $12 thing. I was told by the judge that if I spend one day in jail, the record would be taken off. I also called the same jail today and they could not locate my name or social security or anything for me on their record.
I would not want to unncessarily draw attention of my employer, lawyer and officials on my form by replying yes to arrested or convicted bcoz I dont believe I was convicted.

Could someone suggest me whether I can safely reply No since no record for me existed in the jail? This is really important.
 
Dude .. I think u have more serious problems than thinking about disclosing it ..

Check the maximum penalty for Shoplifting on the state. If the maximum punishment for shoplifting exceeds 364 days . I'm sorry to say u r in deep trouble.

Don't ever hesitate talking this to ur lawyer.
My good advice is be AFFIRMATIVE in all aspects with INS. This is less head ache..

But one thing I'm affraid for u is Petty Theft is a indictable offense as far as I know , if the state maximum punishment is Jail for more than one year and some states do ..

Immediately talk to ur attorney ...

What the hell u let them charge for $12 anyway. U should have thrown some 100 bucks and get out of the store...

Was never convicted!

I just found out from the court that the case was dropped in court and there was no convictions for me. How does that help now.
I wrote on the form that I was arrested but was not convicted.

I am not sure why you got the impression that I was going to hide this info. Infact, I did mention that I had wrote on the form that I am going to write arrested but not convicted.

I have a major problem here.
Few days back I was caught shop lifting. The security person called the police, but they didnt do anyhting, they just wrote the report and went awat saying that these days they are not doing anything. They didnt give me and document, didnt charge me or anything. The store people asked me to do some paperwork which i did, on esaid that i had taken something unlawfully from store and mentioned the items. this was just store paper work .

I was not charged or anything.

so do I have to yes on the forms which ask have you ever been charged, convicted, cited.etc or commited a crime for which you were not arrested ?

Am I guilty, there has not been any court case to establish that?
Do I have to say i commited a crime, the police didnt take any statement from me or anyhting.

this happened in maryland, i have been trying to find what is the max sentence for petty theft in maryland but was unsucessful, if you know pl let me know .
