Shall I catch the deadline before PERM?

hi, I'm new in this forum, and new to LC. My employer just post the advertisement for me these days. According to the rule that the employer could submit the labor certification after 45 days advertisement, it's almost mid - Dec then they can submit the labor certification for me.

My question is, since the new PERM is most likely to be in effect by the end of this year, do you think I should wait to next year to apply Perm? or try to catch the current LC rule before the end of this year? I understand it's not certain in either way, but I'm still so confused. My attorney insists that the earlier the better, but If my application is submitted before the PERM in effect, then my case would definitely be sent to BEC( Backlog ?? center) , which makes me even more confused that my case would be procedured under PERM or current system.

By the way, my case is in NY. Currently it's still processing 2001 cases, I don't know how long it would take. Will the Regional office just stop accepting new applications just by 12/31/2004? or they will continue accepting cases until 60 days after PERM in effect? My attorney usually takes two weeks to my every request, I'm not sure he can prepare my case immeidately after my post ends. If I missed the 12/31, then do I have to go through PERM and I have to re-post the advertisement?
