Serious Crisis - Need Help/suggestion

Hi All,

I am facing a crisis and any suggestion/feedback is appreciated on the following issue.

I filed both I-140/485 concurrently under EB-2 NIW in Sep. 2005 at VSC (for my wife I-485). So I am the primary applicant. I got I-140 (EB-2NIW) approved on March 1, 2006.

In June 2006 I filed I-140 EB-1a at NSC. Since then the file is pending at NSC. On July 13, 2006 our I-485 file has been transferred to NSC from VSC and I got the transfer notice from VSC.

We did not realize the mistake made by VSC where they have given me two A# (one for I-140 and another one for I-485). IT SUPPOSED TO BE ONE NUMBER. In both I-140s (filed under EB-2 NIW and EB-1A) the same A# is there. Surprisingly the assigned A# for my I-140s is the same number of my SPOUSE A#.

How to go about this problem? Hope you got the problem what I am facing right now.

yes your situation is unique...

as you may have already come to know....your spouse is supposed to get her own A#.....so you need to get that rectified by following up with uscis...

and then of course you need to follow-up and get the difference in I-140 and 485 A# resolved.....

Thanks for your response. Which service center I should call? the mistake was made by VSC but our file has been transferred to NSC in July 13, 2006. I am utterly confused.

My suggestion is to explain everything your immi. lawyer and ask for his advise. The other option is to take infopass appointment or use POJ trick to talk to an immi. officer directly and explain him/her the whole situaiton...

which immigration officer VSC or NSC. Because the mistake was made by VSC and now the files are at NSC (I think so because i got the transfer notice from VSC).

This has happened to one more person in Dallas.He went to local office informed them of the situation. They consoldated two file into single file. He came to know because of denial EAD saying no I-485 is pending for him.

In my case we got EAD and AP twice and there was no issue. we realized this problem (A# issue) only because my attorney sent a letter to NSC asking about our present case status. He got a very very WEIRD and utterly confusing notice from NSC. The letter was addressed to Mr... c/o Patrick mentioning my name with different A# (completely different from what I have for me) and The letter concerned the I-140 petition of "my name". It says that your case is currently waiting to be reviewed by an officer". That is how we caught this mistake (A#).

It might be a typo. Did you check your I-140 approval notices ,I-485 receipt notice ,EAD and AP. Are they different?

I-140 (EB-2NIW) approval notice has got one A#
I-485 has got another number
EAD & AP got the same number as that of I-485

EB-1EA I-140 receipt notice has got the number of I-140 eb2niw

Interestingly this A# (in my both I-140s) is the same number of my SPOUSE. Is it not very weird? My attorney tried to call but NSC is not entertaining the phone calls. that is what my attorney told me. if you have any suggestion please pass on to me.

Do you know the person who got into the same problem (you were saying that he is from Dallas)? how did he make th eproblem goaway?
