pv1976, what was your I-140 approval. If I remember from I-140 forum my I-140 got approved after few day your I-140 got approved.

But here you are waiting for final approval and I did not even receive FP2 notice

I-140 approved 6/23/03
EB2 NY
I-485 ND 9/26/02
FP1 result received 11/5/02
EAD3 ND 5/3/04 (pending)
Good luck
Hope all of us get our approval soon

My I140 was applied in July 2002 (I filed my I485 later on in Sept 02). The I140 was approved in June 2003 (after 11 months).

I read some where in this forum that - USCIS director recently testied that FP2 not required, is that correct?

Thanks pv1976. So I did remember correctly. Mine was the similar case I140 and 485 seperately

Good luck. Hope I get FP2 soon.

gcinfo1971, That statement was for for the newer FPs which would be stored at diff. location so it can be held for more than 15 months.
With already expired FPs this strategy is no good

For concurrent filers, priority date (usually around the time that you filed your I-140) is an important factor in getting processed and approval.

Guys Please advice me how long to wait after I-485 RFE submission

--------------------------------------------------------------------------------

Dear friends:
First of all accept my thanks to all, thsoe are keeping this thread is really valuable source of information to all.

2. Then applied I-485 ( ND : 09/23/2002)
3.1FP ( 10/01/2002)
4.RFE on I-140 on march 2003
5. I 140 approved on (09/15/2003) NIW
6. 2FP 05/19/2005
7.RFE I-485 05/27/2004
8.RFE received INS on 06/ 15/2004 ( EVL, J1 Waiver, IAP-66 forms)
My point is how long it will take maximum to get approved. Minimun may be 2 days but I want to know maximum I can expect , if before that, it got approved by GOD's grace ok.
As my case is NIW, I got an job offer in a good school, do you people think I will move before my final approval. My last date to accept this job is June 30th, 2004. Kindly advice guys.
Thanks
Jayram

There are people who have replied to RFE in last year November and still waiting for their approval. There are quite a lot of people who are waiting for more than 3 months after replying to the RFE. Approvals are coming for peope having Receipt dates in ther range of Oct'01 to April'03 . Within that range any one might be approved any day and any one might wait for another 1 year. That is the reality.
As for your dilemma whether to accept the new job or not, i would say, accept it only if the new job description is going to match fully with the job description in your LC. Otherwise, don't take the risk.

Dear Dsatish:
Thanks for your information. People after RFE submission within 3 days they aregetting approval. Really really crazy? Thanks for your advice.

I just want to caution you (and every one else) against having any expectations from INS. Just because a couple of people get approved within 1week or 1 month of replying to RFE or giving FP2, that does not mean that it might happen for majority people. From my observation of all the postings, there are more people for whom nothing happened after RFE or FP2 than those for whom something happended soon after RFE or FP2. The bottom line is, just don't expect timing of approval. They (INS) are doing everything in random. If you are lucky then you will be the beneficiary of their randomness, and if you are not lucky (as those 2001 cases still out here), then you will suffer from the random approvals.
I am in the process of preparing a letter addressed to the congress men complaining against the random approvals and statistics manipulation by INS. That letter should be ready within next 2 or 3 days. Once it is reviewed here, we will send it to all the congress men on behalf of immigrationportal.org
