I cann't beleieve what I am seeing
EB 1 & 2 : not U even for India

Well, a lot of lucky ones who has a late PD like 2004 and 2005 who can file I485 before retro hits on 2005 just get out of this GC hell. I had a PD 04/2003 (original) and we have to wait until the next flood gates up. :eek: :confused:

I once predicted, lifting the flood gates are not a good thing at all. Becaz, it will screw up the approval pattern that USCIS just barely formulaize after the 2005 retro hits. Now, the one (that is me) who is just being unlucky (cannot file I485 before retro hit back in 2005) will need to stay for a while.

It really upset my stomach. And I bet, a lot of other unlucky ones will feel the same.

I made many assumptions when I typed that statement about getting a FP notice and sealing the GC process. Here are my assumptions -

Given that USCIS is doling out GCs for EB2 applicants from India from/since Apr 2004 even for fiscal year 07, it is safe to assume this trend to continue for fiscal year 2008, which starts in October. Visa numbers would be available for my case (Feb 04) in Oct, Nov and/or Dec of 2007 (usually three months to fill the quota, if at all it happens).

Based on these predictions, a four month period is enough for me to get my GC assuming I clear the name-check/FBI check with no major hurdles.

But, the process has to start with a FP notice.

So, does having a FP done means that the Visa Bulletin does apply to you anymore?

I just landed in India when the June VB was out and was adamant to returning right away. With such a leap in dates, I expected EB2-India to stay in and around 2004 for a while (an assumption that seems to be true) and did not bother to come back when I saw July VB, which said every category was current. I thought I had time till 31st of July. Haha. Was wrong.

As cocky as I am and the risk taker I am, two characteristics combined together led to this delay. I am happy that I sent my app at least now.

GC sooner rather than later??

Does the Sep visa bulletin mean that
USCIS has not used all the visa numbers for the year?
USCIS has to use the visa numbers in the next month or will waste them i.e. processing has to be complete before Sep 31st?

Does this mean that people who applied in June and July might see their GC's approved by Sep 31st i.e. sooner rather than later?

Can USCIS not work on a excel file with everybody updating their cases and saving it to the SAME file so all depts know how many visa numbers are left. Never seen such a f...ed up system

My speculation is EB2/India may not move a lot beyond 2005 becuase starting 2005 when the great retrogession started many people have converted to EB2 simply because EB3 looked really bad. Not sure but this is what I think

Nonetheless, USCIS is a different animal. It can surprise everyone.

true; but haven't they all filed their 140\485 by 8/17/07?
Further, I do not know that more people converted to\applied in eb2 (than eb3) in 06,07 because for IN, eb2 and eb3 were practically moving at the same pace.

The only ones waiting to file EB2-485 are BEC waiters and those whose PERM has been stuck in one of those nasty audit checks and new PERM filers in 07.

We may be surprised with the dates in october bulletin. DOS will not make dates unavailable\severely retrogressed simply on the premise that CIS has a lot of cases that have been filed pre-8/17/07 because
a) it will take days before these apps are receipted by the CIS
b) months before 140s are approved.

BEC EB3 cases to PERM EB2 cases could be many

I know cases while EB3 labors are pending in BEC, went through PERM process with EB2 and even got I-140s. Once after that old EB3 labor cleared , porting that PD to the new PERM EB2 cases. I do work for a big company and they are liberally allowed to pursue in this manner.
