Separate I-140, 485 for me and my wife

My Labor has PD of Nov 2003 (EB3) and I-140 has been applied (currently in premium processing). My wife's Labor has PD of Feb 2007 (EB2) and has been approved via PERM process this week. My question -

1. Can both of us apply for I-485 separately in July 07 (assuming my wife applies for concurrent I-140, 485)?

2. If not, then who should apply for I-485 given the PDs?

3. If we both apply for EAD (I-765), can my wife use it and I still be on H1-B?

Any advise really appreciated.

I asked the same question in the forum and so far none replied yet.
I spoke to my lawyer and he claimed that... there is NO rule in CIS to prevent you to file two I485s by two I140 (in this case, my wife and myself) but it will cause delay becaz of it will need cross referencing each case before they can approve.
I am in the same boat and don't know what to do...
