Senator Won't Help Cuz I Have Lawyer

Hi All:

Would like to get your advice on my situation.

It seems that some people got help from Senator. So I contacted
Senator Kennedy's office for my delayed I-485 case.

However, they said since I have a lawyer, I should ask help from
my lawyer, not them. But my lawyer doesn't want to help
at all! She always says my case is a normal delay. It's just
a matter of time.

What reasons shall I give to the Senator's office in order to get
them to help me? My lawyer's correspondence showing that
she doesn't want to help? Then the Senator's office may say
since your lawyer considers your case as normal, you should
just wait.

Any advice?

I was told by my lawyer the same thing. He would not help before the case has been pending for 24 monthes.
I don't think contacting Senator is helpful. Whose case got approved by contacting a senator?

By the way, did you go earlier to do the second FP than the scheduled?

Tell them that your lawyer said that "at times senator can help in sending an enquiry for cases that are past the processing date".

See if the above works.

Also were you able to find out if the petition has been sent to VSC - Director ? Are we going to do the email campaign too ? Please let me know.

I did my 2nd FP earlier than the scheduled time. The scheduled
date was June 19. I did it on June 4. As long as the FP office
allows you to, there is no problem. I heard a lot of people
did the same.

Thanks for the advice! But if the Senator's office calls my lawyer,
they'll find out that my lawyer never said that. My lawyer is
real tough to me, BTW!

On another note, the petition has not been sent yet. Rajiv will
collect more signatures this week. It will be sent either
later this week or early next week to the Director of the VSC.
 
clueless, asking senator help very much likely will get your case transferred. Do you want that?

you have submitted second FP, the only thing now
is wait. I guess August will be better. Seems
this month and last they shift to do sth else.
But they will shift back sometime.

know what a "transferred" case is, BTW. Can you explain it?

If I just wait, I don't believe they will touch my case at all,
because I have never received RFE. I feel I must do
something about it.
 
Senators have better thing to do in life than work on some delayed 485 case. Its just a sign from their office to not bother them with these kind of requests.
 
transfer your case to local officer takes 3-6 months or possibly longer. After interview, you probably need another couple of months of wait to get stamped(varies).
 
Clueless, if you know sb in VSC, then you can let them pull your case out and adjudicate immediately. Some lawyers have liasions
with VSC.

Your lawyer is not reasonable at all. You can point out to her the actual processing time of VSC, let her know you're Oct case, it's not normal delay at all.

But since you did FP on 6/6, I would think your case will be approved soon. 1.5 months after redo FP.

Just hold on and wait till end of this month, what do you say?
 
clueless, another thing you could tell senator is
"after the BCIS phone service centralized, lawyers can't call VSC to get information about case status too, same as clients. "
 
Ted Kennedythe Ultra liberal did not want to help a hapless immigrant? This is what you get from the far left, they express sympathy for the downtrodden but nver do aything. You are likely to get more help from a moderate republican pro business senator but alas you are in MA they don't elect such people ( your governor is there by chance).

Now I'm concerned about what you said about getting
transferred to the local office. I don't want that to happen.
Are you sure they will transfer my case if a senator contacts
them on my behalf?

On another note, it would be great to get some internal person
to help to get my GC approved at the VSC. But my lawyer
is more like a bitch than a professional. What can I do?
 
clueless, I read somewhere from this board that more likely your case will get transferred if you contact Senators. i don't know if this is correct. Days ago I saw a case like this

I called Senator Kennedy's office again. The aide was very nice.
I told her there was not much my lawyer could do to help at
this point, especially after the VSC's phone # was cancelled.

She talked to her supervisor, I believe is Emily Winterson.
The supervisor seemed irritated. She re-iterated since I have
lawyer, I should ask my lawyer to help. She also added
this is the immigration LAW.

Has anyone heard about this immigration law? It seems that
they have made up their mind in not helping me. I gave them
reasons for my lawyer not being able to help. However, it did
not make any difference in their decision.

What a depressing day!

Must have been quite frustrating to hit the wall.

I guess all we can do and hope that the petition works as miracle for us!

I really have pinned my hopes on it.
