Semi Concurrent Filing ?

Hi,

Looks like TSC is going by Conucrrent filing of I-140 and I-485.

Mine is a substitution case with I-140 RD : 09/05/2003. There is a last update date as 09/10/2003.

Would it be a good idea to file for I_485 as semi Concurrent application ? I think it will also save me extending the H1 again for next year as I am already on 7th yr. extension.

What is the criteria for semi-concurrent filing ? Any inputs would be of great help. I am planning to disuss this with my lawyer today.

You should go ahead and file 485 and as long as you file 485 while 140 is still pending, it will be considered consurrent. This has been the outcome of all the discussions we had in other forums here. However if you file 485, both 140 and 485 will be adjudicated together which will delay the 140 approval also and you wont be able to use AC21 which you may if at all ur. 140 gets approved in next few months.
