Semi-Concurrent Filing Question...Please Help experts ....GINNU, REALCANADIAN

I have just applied for my I-485 based on a pending I-140 (EB2/India) - became current on June1,07. The I-140 was applied in Jan07 (5 months ago) and is pending at TSC. I'm sending my AOS applications to NSC.

Question:

1. Will my 485/EAD/AP applications be moved to TSC (since my i140 is pending there)?

2. Once my I-140 is approved, do i need to inform the service center where my I-485 is pending OR is it internally taken care of?

3. Should i premium process my I-140? Would appreicate if someone could explain how/at what stages - a pending I-140 could delay the I-485 processing?

1. It may move to TSC or it may not. You may even try sending directly to TSC if you'd like, since that's where your I-140 is. I don't think that will be a problem (but wait for others to post below).

2. It is internally taken care of. Remember, you are entering your A# on your forms, which is the same A# on the I-140 receipt notice which you will be sending with the application.

3. That's entirely up to you. There is little or no real chance that a pending I-140 can delay a I-485. In fact, many say that having a pending I-140 will speed up the I-485 right behind it (although that's not always true).

My 3rd question still remains unanswered. What i really wanted to know is that - for the sequence of tasks in the processing of a 485 application (like fingerprinting, background check, look for approved I-140, etc.) - where does the I-140 approval hold other things? Without an approved I-140, would USCIS stop issuing fingerprinting, name check requests?

No, USCIS will still schedule your fingerprints and initiate a name check based on a properly filed I-485 regardless of whether the I-140 is approved. Basically, when it comes time to adjudicate your I-485 (i.e., your turn comes), they will check for the approved I-140. If it isn't approved, they will put it back on the shelf (probably a separate shelf for 'lookout' cases) and pull it back out a few weeks/months after the I-140 is approved. You may get a notice for a second fingerprint appointment if 15+ months pass from your first appt and your I-485 has not been approved yet. Hope this helps.
