Self employment and AC21

I am starting a Limited Liability Company in partnership with my son (who is on EAD as my dependent).
If I get a new contract from my client for doing the same job as now, can I use AC21 and be employed by this new LLC (which is owned by me and my son).

While the latest USCIS memo allows this, I am thinking it might be too stressful for most of us to try out (and then find the pitfalls). Technically if the same/similar job requirements are fulfilled you should be ok, but can you prove ability to pay?
