Atlanta brother? is it right answer?

If you were in the USA before 26 in any status other than LEGAL non-immigrant status, you must enroll in SSS.
stonem27,
You do need to explain it, and you also need a letter from SSS office.

CrossHairs,

The thing is I also went out of status for few months while I was on F-1 status. I got myself re-instated and that chapter of out of status was closed. What I am thinking is, since stonem27 got his GC after the age of 30, that automatically waives him to enroll in SSS. I think a quick call to an attorney wouldn't hurt.

When you get the GC is irrelevant to SSS
What matters is:

1. Were you in USA before age of 26?
2. What status were you in continuously? If there are gaps where you were out of status(not a legal non-resident), you need to register.

GC age is irrelevant to this.

stonem, should request a SSS letter and can explain at interview if asked.

CrossHairs,

I came to US when I was 19. What does that tell you? Ofcourse I was in US before the age of 26. I never requested for a SSS letter.
The way I understand & I am pretty sure. If you (all males) got your GC after the age of 26, then you are exempt from this.

Sorry, but your interpretation is incorrect.
Any time a person is in the US between the ages of 18-26, in any capacity OTHER than a lawful non-immigrant, they need to register for selective services. Since the OP already said he was out of status during the period in question, it stands to reason that he needs to mention that he failed to register on his N-400.

The good news is that since the OP is obviously over 32yrs of age, the failure to register falls outside of the 5yr CIMT window, so it will not be a disqualifying event.

I repeat:

Age when you got the GC is not really relevant to SSS.

The rule is:
Any time a person (male) is in the US between the ages of 18-26, in any capacity OTHER than a lawful non-immigrant, they need to register for selective services

selective service

Thank you all for the helpful hints .Now My question is since I did not register before 26 even though I was here (out of status), which many do,if I just check no on the form, will they cross-question or go back to see when i entered the country? do they even check to see if we were registered? ..has anyone of you been in this situation?
Thanks-Mike

stonem,
You have to answer the N-400 truthfully, and if question comes up answer it truthfully. You will be fine, I dont think you will have issues.

Actually your current age (and hence GC age) is VERY relevant to the SSS problem.

(D) Applicant Older than 31 . If the applicant files after his 31st birthday, more than five years will have elapsed since his failure to register. Therefore, the failure to register will have occurred outside the period during which the applicant must show that he is of good moral character. This means that even if the applicant willfully and knowingly failed to register with the Selective Service, this fact would not, in and of itself, be a bar to eligibility so long as the applicant has currently satisfied the good moral character requirements of section 316(a)(3) of the Act. However, if the failure to register was willful and knowing, you can consider this fact with other evidence concerning the applicant’s compliance with section 316(a)(3). The applicant should provide the status information letter discussed in the memorandum located in Appendix 74-7.

Boatbod,

What I'm saying is "whether you should register for SSS or not" is not dependent on the age when you get GC.

If you did not register for SSS when you should have, then your current age (not age at GC) when you file for N-400 will be somewhat relevant - Yes.

Lets say you had to register at age 22-23 for SS, and you get GC at age 24.
You will be eligible to apply N-400 around age 29.
However it is better to wait till 31 or 32 to let the statutory things go away a bit. Current age determines this (GC age can be 22, 23, 24 whatever)

Yes, I agree.

Yes, but in 99% of cases, the two are linked; a person who gets their GC at age 30, is not normally eligible to apply for N-400 until they are already outside the SSS CIMT period.

Lets say you had to register at age 22-23 for SS, and you get GC at age 24.
You will be eligible to apply N-400 around age 29.

True, but the OP didn't get his GC until later.

Anyway, I think we're pretty much saying the same thing.

My interview letter lists these documents to bring >>
1. This letter (interview appointment letter)
2. Alien Registration Card (Green Card)
3. Any evidence of Selective Service Registration
4. Passport
5. Items noted below if aplicable (none).

My question is on on item 3 above >>

1. I came to this country when I was 27 on a B1 visa. After a couple of years, I applied for H1 visa and then for permanent residency.
2. I got my green card when I was 33.
3. The SS site states that there was no registration during the years of my birth, and I have a printout of that
4. Do I need to take anything at all - relating to item 3 above?

Also, I see the same list in my wife's IL. Are women required to give anything related to selective service registration?

Thanks a lot for your guidance.
