Seeking URGENT advice - Mess up in Dallas Backlog Center

My labor cert was filed with the Louisiana (LA) State Labor Department in 11/2001 through the basic (non-RIR) process. In 7/2004 my employer received a letter from the State (not Backlog Center) Labor Dept if they were still interested in the process and my employer replied affirmative. I haven't ever since heard anything on my case. I went to the website of the Backlog Reduction Center and noticed that the labor filings from the state of Louisiana were sent to the Backlog Reduction Center in three stacks. the first stack covered the ones filed between 2/2002 to 12/2002. The second from 1/2003 through 12/2004. And the third from 10/2001 through 3/2005. I assume it was a mistake on the part of the LA Labor Dept not to send the files from 10/2001 through 1/2002 in the first stack. That is why the cases with priority dates in 2002 are receiving the 45 day letter notice but I haven't received it yet. Since this problem needs to be corrected can you please suggest what steps should I take? I tried to call the Backlog Center but you can't talk to anyone unless you know whom you want to talk to! PLEASE HELP.

out of order 45 DL and processing

This is very common, all local SWAs and regional DOL offices didn't forward the cases in a systematic pattern. So, cases filed later were sent earlier, very common mess. Nothing new here, 45DL are sent out of order, as and when they like and want to. Same goes for processing order, we have been trying to derive a consistent patternt for 45DL and processing without any success. Their latest timeline says all 45DLs would be sent out by June 2006, so there is nothing you can do till then. If you want, you can contact local congress representatives or senators and they can try to find out info about your case. Some people are trying to raise some money to file a lawsuit, you could support them, if you think BECs are not doing something right.

Thanks DGB. It's very frustrating. But thanks for clearing my doubts. It's sad that cases are being approved in a haphazard way and not as promised as FIFO. Looks like lawsuit is the only option but it's again so time consuming.
