Seeking UN and other Senior folks's opinion

Guys...Time for me to take a decision and I need your benign suggestions. I have following 2 scenerios....

Company A- ( Revenue around $35 Million)
(i) Currently working. my own Labor pending in BEC since June 2004.
(ii) Filed I140 & 485 in EB3-Dec2004, using a substitute labor (PD 2001) of an ex-employee having "computer related" MS.
My Edu + exp. (BA (Eco.)+ MS (Finance) + 5years Exp. (IT)) was combined to establish the equivalent to MS (Computer related). I140,I485,AP all are pending due to security check on file. Wife's finger printing was done in April-2005 and mine were never taken.
(iii) Less salary and subject to their Exploitation. :mad:

Company B- (Revenue around $50 Million)

(i)Offering a very good Salary & Benefits.
(ii)Ready to file my Labor through PERM and start the (never ending) GC process all over again.

If I stick with company A, I'll be subject to their unfair exploitation. I am bearing it just for the approved labor sake. I don't even know if the odds of getting my I140 approved, using this company's approved labor is in my favor or not. If not then,obviously there is no point in sticking with them.

I am in a dilemma as which one to pick ?? :confused:

Please share your opinion all of you Gurus, specially UN and other senior folks...

wait and see...

Looking at your trail. It makes more sense to wait for I140 aproval or some decision on it before jumping the boat.
question to ask is 1) Is subsitute labor is still honored by VSC? As soon as I140 gets approved you could apply AC21 and jump.

if you go with new company..you would have lost 2 years or more of priority date....GC track is always money loosing business....bear with it for few more months before taking the extreme step.

Thanks RajuDM...appreciate it...whatever you said, made lots of sense. My I140 is still alive and whenever I call USCIS, they tell me that they are waiting for security check clearance from Agency. So, it seems like VSC still honors the Labor ? not sure though :confused: ....
Beside, I don't even know if anybody at USCIS peeped into my I140 file yet or not...a little concerned here because of the fact that USCIS has been creating issues where edu+experience is combined...hoping for the best and trying to hang in there....

I am not sure what anyone think but PD2001 is much better than PD 2006. You don't have that many 5 years on your life.

I also agree with everyone that PD 2001 is much better than anything....but your substitute doesn't look stronger to me. 2 key things, which USCIS uses to get back to the employers/ immigrants 1. Educational qualification and 2. ability to pay. equationg 4 year engg to 3 year BA is very difficult. Think over.......If I am at your position, I would take second one....make more money and keep extending ur H1. may be after 5 years u will decide to go for good, at least by then u would have made some money
 
Wait a little !!

If I 140 is approved there is a better chance of getting a GC.
Also you might be able to keep the PD incase you move ..or AC21 is also a good idea ..but not a very smart one..I would say wait and keep on the VSC to find out ..write to FBI.
No point in doing it all over..unless you think the wait is endless.
 
Kishore, Thats what bothers me the most ....Although my Labor doesn't demand an engineering degree...it requires a "Master or equivalent degree" in "computer related" subject. I do have a Master but not in a computer related subject, so my IT experience was combined. I thought I'll give it a shot see if it works....if it had, I'd have invoked AC21 and left....but its been pending for more than a year now and meanwhile I am also not making money....I need to decide which way I should go...so I thought I'd post in the forum and seek people's opnion.....Thanks a lot for the comments....
 
The problem is that I don't know how long more should I wait ?? I might not have the luxury to change (Option B) after a while....Guys...please respond more...what happened to UN,Dazzlinbg,Jharkhandi ?? UN, Are you still in Australia ?? Please respond if you are back.....would appreciate it...Thx everyone....
