Seeking divorce from spouse who has not received green card yet

I have been married for 9 months and my spouse is abusive, refuses to work, and has been sending love letters online to another lover. I want to get a divorce but am wondering what impact this will have on his status as well as what responsibilities I will have to undertake (on top of all the legal fees I have already undergone for him) if I proceed with the divorce?

I thought it was illegal to work unless you have a GC ... don't hold that against him.
For all the other things he's done to you I'd kick his ... file a devorce, revoke the i-130 and he'll be back in his home country soon.

Rex1960, I am surprised to read that somebody on this board can actually think that working without GC is illegal….Especially a person, who already filed I-765 (I can see that from your signature) :rolleyes:

People can and do work with EAD all the time, while waiting for their I-485 to be processed.

On everything else, I agree with Rex. File for divorce, Uslady, take a copy of NOA for I-130 and send it back to MSC with a letter explaining the situation and request to withdraw your I-130 application.
You won’t be responsible or accountable for anything else (expect maybe the court fees for filing for divorce). As to his status in US – it is his problem, not yours. Once you revoke your application – his lazy cheating a** will be on his own. Good luck!

I was assuming he's still in some sort of progress and waiting for a working permit as you're assuming he's already through and having his EAD in his hands.

He has already received his work permit, as well as social security number. Problem is that in NC you have to be seperated for a year before filing for divorce. I wonder if there are special sercumstances.......

You can revoke your I-130 before it is approved. A man is " abusive, refuses to work, and has been sending love letters online to another lover.... " is not worthy your love. :(

If what you said here is true, there is only one thing to do: FILE FOR DIVORCE a.s.a.p. and make sure his papers don't go further with CIS...we don't need another s.o.b. in this country!

You can withdraw the application.....afterall YOU are the petitioner and he is the beneficiary. Go to the USCIS and tell them you wish to withdraw your applications because you are in the process of divorcing him...which involves a required seperation. Seriously, don't let him use you like that....you deserve better.

P.S. The work permit is only valid because he has pending application...AND the social security can only be used with VALID work permit.

Please do not help criminals and crooks to immigrate in this country. He have our own, we dont' need to "import" more from other countries ;)

In my opinion someone who uses another person to get married and immigrate here is nothing but a crook, and the fake love marriage for immigration purpose it's a crime which should be not only penalized with deportation but should be criminally prosecuted.
