Seeking clarification on forming an LLC with EAD card and I-140 pending for approval

Hi,

This is regarding forming a company on EAD card.

My wife is in U.S on H4 visa and received her EAD card as a dependent to me.

My 1-140 & I-485 are still pending for approval and I am the prime applicant for GC.

I would like to know whether my wife can form a company, in specific an LLC in the state of Nebraska, with her EAD card.

I realize the major risk here is that if by any chance, my i-140 is denied, she will be out of status and I have to apply for her H4.

Apart from that are there any hidden implications that would affect her as well as my GC process. Is it legal for her to form an LLC company?

Any clarification will be of great help.

Through my personal experience, you don't need to be a permanent resident / EAD to form an LLC.
