I was on an H-1B visa and had been in the United States for a total of five years, including my time on both F-1 and H-1B status. Recently, during my return to the U.S., my H-1B visa (valid until September 2025) was canceled at the port of entry. Following a lengthy interrogation, I acknowledged that I had agreed to a percentage-based arrangement with my employer, which led to my deportation back to India.
Given this situation, I would like to explore my options for returning to the U.S. I am particularly interested in understanding:
  1. H-1B Cap-Exempt Petition: Am I eligible for an H-1B cap-exempt transfer with a new employer?
  2. New H-1B Sponsorship: Can I re-enter the lottery system and apply for a fresh H-1B petition?
