My friend applied for H1B visa stamping in the US Consulate at Calcutta, India thru the drop-box facility available. They returned the passport without the visa stamp along with a letter saying that under Section 221(g), she will need to go to the consulate for a personal interview. The earliest appointment available thru the TTS services is July 6th, 2004. She needs to return to the USA this weekend. Her current H1B visa stamped on her passport is valid upto July 19,2004 and she was applying for the new H1B visa valid upto July 19,2005. Is it possible for her to enter the USA on her current visa stamped valid upto 7/19/04 and then apply at the Department of State or in Canada ?

Sure she can, if the visa is not cancelled. But she cannot get revalidated in USA or get it stamped in Canada.

No she cannot

If you look at the last page of the passport, there is probably a stamp saying appl recvd and a 221g handswritten. If your visa gets rejected or 221g then you cannot enter back, unless you het a new stamp

Unless there is major oversight by immi officer, he/she would notice that, not to say that the info is in their database now and will deny entry.

please read previous threads. I have read somewhere that u can come back as long as ur visa current visa is valid and has not been cancelled with prejuidice.
