Secondary Birth evidence

Please help : Secondary Birth evidence

I received an RFE for Secondary evidence of birth. Can anyone
kindly inform what should be I producing for this to INS.

I have given Affidavit of birth from my parents and Non availability
certificate, since official birth certificate was not available.

Did you give the Affidavits and Non-Availability certificates as a response to your RFE or did you provide these when you filed for 485?

If they want more information I am not sure what else one can provide if your birth was not registered.
 
while filing I give affiadavit from father and non availiability cert.
as rfe I was asked secondary evidence. Somebody, told
get more affiadavits from relatives. I am working on it

I dont understand the logic here..(i know I am not supposed to think logically hehehehe). If you dont have a BC, you are supposed to submit affidavits and the non-avail. We try to get the non-avail with lots of difficulties and after submitting everything, ask for secondary evidence ?..this sucks!

May be more affidavits from uncle or any other close relative/ copy of school leaving certificates with the DOB on it...just a guess
 
Birth Certificate

If you do not have a BC this is what you need to get and submit to INS.
Each applicant will need the two signed notarized affidavits (one from each parent). In addition each applicant will also have to contact a local competent government agency in your home country and have them give a notarized affidavit stating that a birth certificate does not exist in your name. This certificate is called a "non-availability certificate", and again, it also must be notarized (notarized here means the seal of the government authority issuing the non-availablity certificate).

Birth certificate

Secondary evidence:

In my view a secondary eveidence can be a school certificate
with date of birth on it, a hospital birth record, child entry on mother's passport with date of birth of child, vaccination certificate ...... and can be a long list where the date of birth and name of child is mentioned. Noterize it first and send it.
 
Guys,

I have submitted the BC which I took from Indian Consulate in Chicago, just before applying for 485. Will this be enough or they will need some more evidence?.

BC issued by the indian consulate may not be enough as it is issued based on the information on your passport. Although it might be acceptable as secondary evidence.
 
Anyone from Bombay who got Non-Availability Certificate.

Hi Guys,
Anyone from Bombay who got Non-Availability Certificate. We tried getting it from Muncipal corportaion. They are saying they have no idea about the non-availability certificate. But they suggested us to apply for a new birth certificate with correct date and they will respond to it with in 2 weeks.
I already have a BC but with different date!! So I can not use that one.

This is just my guess on the BC issue, if you dont have a BC.

If you dont have a BC, then you HAVE TO submit 2 affidavits(from father, mother) and a Non Avaiability certificate from the municipality/corporation from your birth place(as in passport).

You may also get affidavits from your close relative in which it should state, that the relative was present at the time of birth and she knows about the birth. (formats of affidavit from relative should be available if you search).

From my exp, if your non availability is not from a Government institution like municipality/corporation, they will send an RFE I guess.

For seconday evidence, you can send affidavits from relative, and school certificates showing the date of birth.

If you can not get non-availability(some places, they dont issue), you have to try to get the BC via court or something.
