I am primary applicant, I140 approved in Jan 2005. My husband and myself filed I-485 last Feb 2005.Did first FP in May 2005. Congressman inquiry this Sept revealed that my husbands name chack is cleared and my name check is pending. Yesterday my husband got a notice for FP code 3. Does that mean that they are getting ready to approve his I-485 while my case is pending ? What do you guys think ? Is it new shinanagan from USCIS ?

Primary vs Dependent ..

A dependent cannot be approved prior to the primary applicant. There have been times when both have been approved at the same time but the dependent has been informed before the primary but this is more a case of notice delays. As a rule dependents cannot be approved before the primary applicants. Primary applicants can be approved while dependents name checks are pending.
