second six year term for h1-b

After the first 6 year H1-B term expires and if you do not have any pending or approved Labor for 365 days ,

1) can you start the petition for the second 6 year term 1 year ahead of schedule ? assuming that one has to leave for a year
 
thats a good idea !

Anyway H1s are taking 6-9 months to get approved.
However be sure to file the new H1 only after you have actually left the USA. Never come to the USA on another visa/status in the 1 year time. get a really good lawyer..I can imagine so many problems if you dont get one...make sure that your start H1 date is atleast a day beyond the day you have left USA...get a lawyer...get a lawyer..
