Here is my story:
I am currently on H4 visa which is valid till November 2005. I have applied for the extention of stay on 24th August based on my husband's already extended petition which is valid till April 2007.
While my I-539 application for extension of stay is pending, I want to file 'Change of status' from H4 to F1 for full time studies. For which I will be filing I-539 again.
My questions are:
1) What happens to the first application for I-539 if I make another application for change of status. Does the first one gets automatically cancelled if they receive second application?
2) What should I mention for my current visa validity (I-94). Should I mention November 2005 or Should I mention April 2007?
3) If I mention November 2005, when INS will process my second application, at that point of time my information would have changed based on the first application e.g. my current validity for stay (I-94) would have been changed. In that case will they deny to issue F1 for my second application?
Urgent attention will be highly appreciated.
