I have one fulltime H1B with Company A, and got an offer from Company B for part time work of 10 hr per week. Company B is filing for a second H1B for me for this part time job.
My question is, the lawyer for Company B claims that I can start working for Company B as soon as the second H1B application is filed. Is this correct? I thought AC21 only covered H1B transfer, and since this is not a transfer (I will stay full time with Company A), shouldn't I wait for the H1B approval?
Because of this claim, Company B is unwilling to pay for premium processing, thinking it is a waste of money.
