I am filing first time for my GC thorugh schedule A Categorey II (exceptional ability) option. Because that is the only option that is currently open to some one from India and China, who can qualify for that. Fortunately I have US docotorate degree, several years on Indian university exp. and also US University job at present, So I am trying my luck with that only open option.
I need your input and suggestions for on followings
(1) Any one has any recent experience with Schedule A, how tough it is to get approval, any recent success or denials.
(2) I am just starting on my H-1B after F-1 expiary. I dont have any H-1B visa stamp on my passport but It is approved for 3 yr. I am planning to visit India next summer (2007) I have question regarding filing of I-485.
(a) If I dont have any visa stamp on my passport which is valid ( F-1 expired and H-1B not stamped) can I visit India and come back on Advance parole If I go for concurrent filing of I-485 with my schedule A I-140 application
(b) I absolutely need H-1 B visa stamped on my passport to visit india or not. My F-1 stamp is not valid any more.
(c) If I file both I-140 and I-485, then after that can I go out of country (I guess I need advance parole for going out) for getting my H-1B Stamped in canada or mexico, or I can not get my H-1B stamped in the passport once I file for I-485
(3) How much time it takes from approval of I-485 to actually get real green card and what is the process involved in between.
