Scenario: No Job, RFE Issued

Consider this scenario:

No job for past 3 months, RFE is issued for 3 months pay stubs, employment letter and past 2 years tax returns.

Assuming one has past 2 years tax returns, what steps should one take and what will BCIS do, if:

- No pay stubs for past 3 months, but employment letter available from future employer.
- No pay stubs for past months and no employment letter.

People who have similar experience or expect to be in that situation, please post your response. Thanks in advance.
 
Mavishka, How about avoiding all that to begin with !

You can sort of "Pre-empt" the situation by asking your employer to withold the Payslips till a future date. Now you always know approximately when your RD will be processed by INS as and when your RD gets near. So for example a Feb or Jan filer could expect to get approved in about 3-6 months from now, hence if you want to play it safe just ask your employer to Post-pone your Paycheck by that time period. Once you have accrued your required no-of paylips you dont have to worry. Lets say 3 months from now you get RFE for 3 payslips then you can ask your employer to cut 3 paylisps for the last three months (postdated) !

The incentive for Employers is they get "free money" to play with for that time and its perfectly OK to withold Money
for a "Rainy Day" scenario.

Ofcourse there is the huge inconvenience of living on your savings for 3-6 months, and you need co-operation from your employer. And first of all they should be trust worthy !

But yes once you are already in a "No-Job/No-Payslip" situation all you could ask your employer is to "co-operate" on hopes of a better future

Most importantly remember that you have 12 weeks to respond to a RFE ! and that INS has no "resources" to check your
Current tax witholdings and bank balance and so-on and soforth.
