Saras and other experts: What is meant by Out of processing date?

Hi,

I just spoke to USCIS representative and she said that our 485 is "out of proceesing date" (our RD for 485 is June 2002). She has sent a query and has asked us to wait for 45 days!

Apparently our namecheck has been completed (this was communicated even during recent infopass).


Anybody know what out of processing date means? Please provide some information.



My case details:
EB3/INDIA/CSC
PD: APRIL 30th 2001
I 1485 RD: June 2002
current since Jan 2007
Last FP done: July 2005
Infopass: Jan 4th 2007
 
Have you looked at Processing Dates....

USCIS communicates their processing time for each application...monthly or so...
Like, most 485 applications get processed in 6 months....6 months is the processing time...
Looks like your 485 RD in 2002, so it's been more than 4 years...Obviously you are outside processing time of 6 months (way over by 3.5 years+)

Anybody outside of this processing time, with wait of more than 6 monhts, can initiate a query with USCIS and enquire as to what happened and get to know the status of the application...

If your namecheck has been wrapped up, then you should be getting approval very soon!....Best of Luck!

As banta4gc pointed out, your case is "out of processing date" by 3.5 years !!! .... do you know exactly when your name check was completed? ... it generally takes about 1-2 months after the name check clearnce to get the approval... but in ur case, your Fingerprints might have expired (they expire 15 months after they are done) .. so u might get another FP notice and once you finish FP, it should be matter of days....

Well, I dont know when my Name Check was completed. But my FP was last done in July 2005 so it has expired now.

I do hope I get the FP notice soon and be done with this forever!

Harakad,

As others have already suggested, your case is long due for approval since PDs is current and the processing date is way past your RD. You should be hearing something soon. You will most likely get another FP notice (Bio notice) shortly. Hopefully your approval is around the corner.

Everything can be cleared with FBI, but if the IBIS NC have hits, u have to wait for the results from another external agency. Sorry to say that.

"We are in receipt of a response of our inquiry submitted with USCIS on 12/13/2006. USCIS tracking systems indicate that your applications will be pulled from the file room and forwarded to the monthly processing shelf. The files will than be assigned to an officer for review and decision. A decision or transaction should take place within 120 days"

This is great news. In all likelihood, your approval will take less than 120 days.

Quick question for you. Before you initiated the Attrney inquiry do you know your Securiy clearance was done.

Yes I did know that its all done when I went for the infopass. Also, I happened to call USCIS and the representative confirmed that the security clearance is completed...

Anywayz, until I see the card in hand I dont want to believe anything.

It should be your turn. Unbelievable the case has been pending since 6/2002. Has your PD always been current? How much time did they take to clear your security checks?

My PD has been current only since Jan 2007.

I have no idea about when security checks got cleared. Infact I never even asked about it during infopass/call to USCIS. The rep. herself told me that its all cleared during both the ocassions...
 
No wonder you have waited for almost 5 years. Apparently, the long time pending is due to the visa number retrogression but rather the NC issue. Your NC should had already been cleared before your PD became current. Unfortunately, you were subject to the visa number retrogression at that time. So, your case could not be adjudicated. BTW, how many FP did you complete before? Has your last FP expired?

I have done 2 FPs. My last FP was done in July 2005 so obviously it has expired.

I do hope 2007 puts an end to this saga....

I'm in the same situation like you !!!! :confused: My PD is current since Sept 1st , 06 , and still no answer after infopass , calls to CS ( 2 inquieries started in the last 120 days w/CS , and a lot of them before w/lawyers) , contact coongressman , write to FBI , ....and still no response from USCIS !!! I'm just fed up with these guys , and i don't know what to do anymore ???!!! :(

What about namecheck? Has that been cleared...

Hi ,

Name check still pending !!! There are more than 36 months , even if my name is not popular at all , no criminal records at all also , just don't understand them anymore !!! I just have to keep pressing them from all sides , and ......maibe .....one day ....!!! :(
 
Did you get any LUD on your I-485 except for after your FP? It has taken 36 months on your background checks. The Mandamus Action may be the only way to push the CIS towards the end of your case soon.
