San Jose iEAD with RFE on I-140

Does anybody get iEAD from San Jose office while there is an RFE on I-140? My I-765 is pending in CSC for 90 days, I'd like to apply iEAD from location office, but I noticed from on-line status that RFE was issued to my I-140 lately. I saw some conflicting information regarding iEAD issuing policy like "no Request for Evidence (RFE) has been issued on the underlying I-140".

1. No I am not someone who got iEAD at San Jose under those circumstances
2. Unfortunately, they will refuse to issue an iEAD while the RFE is pending on the I-140.

EDITED LATER: See previous post!! Apparently there is hope yet.

Did you need to do anything special?
 
Its just normal. They didnt ask me for anything. I took it in Jan 2003 though. So, I am not sure if anything changed eversince.
