Hello all


As I had posted earlier, I was just given a second RFE for my case. I am a bit nervous because the case officer seems to be taking too much interest in my situation.

Anyways, my previous RFE was for Waiver of J1 Home Stay requirement. I sent that.

Now it is probably going to be for Employee Letter and Pay Stubs. I had switched jobs last year but had not filed AC21 at the time.

Would anyone have a sample of Employer Letter with AC21 that I couls adopt and use.

Mr. xxx has been with us since xxxx. Since xxxx (EAD start date), he is in the position of xxxx (title mentioned in LC) with annual salary of xxxxx (salary mentioned in LC) . His job duties include xxxxxxxxxxxxx(included the job duties mentioned in LC).. Mr. xxxxx is a valued member of our staff.

We respectfully request you to grant him approval of the I - 485 Application/Immigrant Visa in order for him and his family to obtain their permanent residency status soon. Thank you for your help.

This is helpful. Only problem is that my Salary is about 20% lower then my LC. Should I have the company mention the actual salary or the LC one as the future amount.
 
I dont think your company is going to mention anything other than your actual salary. But if you can get them write otherwise, it is fine.
But FYI...salary is not a huge factor in AC21 anymore. There are people who has got approval even with a 70% salary difference. For Ac21, it is the job title and job duties what matter most.
