Same Sex Bi-national Couple Married in California - What to tick on DV lottery entry?

Hi there,

I got legally married to my same sex partner in California when it was legal in 2008.

When I now submit an entry into the DV lottery should I tick "unmarried" since under the DOMA act same sex marriage doesn't exist in federal law and therefore I am unmarried?

Since my partner already has a Greencard he is not an egligible spouse anyways.
I am unsure what to do. If I tick "unmarried" they might say I am untruthful.

Does anyone have an idea?

For the purposes of immigration, you are unmarried.
