I am in the 6th year of my H-1B visa, and have just received approval for my 7th year extension. I am however considering a job change within the same company to a different function.
I was under the impression that this could be done through a H-1B
amendment. However I was told that doing so will jeopardize my current AEC application and the ability to extend my H-1B beyond the 7th year. i.e. My pending AEC will no longer be valid.
Is this true? If so, what are my options if I really want the new job. Is refiling under PERM an option? Or is it possible to refile the existing AEC?
