URGENT: salary problem - please help

Dear all,

My salary rate was lower than that stated in LC early this year.
Now my salary rate is a little bit higher than that stated in LC.
But my W-2 this year is going to be 7k lower than that stated in
LC. If I get RFE in the future and it asks for W-2, could this W-2 be a problem?

I'm on the same situation. And to be honest, it could be a problem if INS issues an RFE for W2 and pay stubs. Some people may argue that the salary stated on the LC is for a future job offer, but this is a question of trust. If your employer is playing with your salary (up/down), how can your employer make INS believe that they're going to give the salary stated on the LC? Basically, it is a matter of building INS's trust level. Just pray that you don't get any RFE.

NO

Don't try getting 1099 showing the difference in salary on W2 and LCA ...it would cause more trouble.

Consult a good lawyer like Murthy.
