Salary Mismatch by +$30K

My salary is $30K more than the Prevailing Wage (PWD is low, not that my salary is too high), Is this a cause of concern? Thanks.

There is no problem as such. However, it means that you may be eligible for EB2, but you are applying under EB3.

You may want to check with your employer/attorney to see if you could apply under EB2. Applying under EB2 may get you through the GC process faster.

This is just my opinion. Your attorney is the best source of information.

I had similar problem. My proferred wage was LOT more than prevailing wage at my previous employer. No problem at PERM stage, but was issued RFE at I 140 stage.

Good Luck

Bhaskar,

The only problem would be if you were getting a lower wage than the prevailing wage offered.
The other thing that we sometimes do is offer the salary RANGE -- I.E. if you make $80,000, and the PW indicated the PW is $50,000, the person preparing your application should indicate a salary range of $50,000 to $80,000.

Good luck !
