Salary lower than specified in labor certification

Dear CP Gurus,
     My actual salary is 5K lower than specified in labor certification. Does it create any problem if I go for CP? I know that at the time of interview consulate officer may ask for current salary slips. If they come to know then what are the possible actions?

not a legal advice - what I know is that GC is for future employment and as long as employment letter says so salary should not be a factor. Any comments CP Gurus.

After CP approval

if your current salary is lower than specified in labor application and if you are approved in CP. After CP approval if employer continues to pay you current salary and not that specified in labor, what are the possible implications? Do they revoke GC or make it hold something?

Hello gurus
My salary has been reduced by 36% due to the economy from the time my LC was applied and I-140 got approved. Please clarify below questions

1. I have asked my employer to provide me salary slip before the CP interview ( for atleast 3 months ). He has said ok for that. For how much duration we should carry our payslip for the interview?

2. Still my employer has agreed to provide me employment letter for the original salary. is that ok?

3. I shall be taking tax returns for the interview. what if the interviewer ask about the reduced annual pay in the returns ?

Salary problem

Hello I have similar problem where salary is 5.3% less than what was mentioned in LC....is that a problem if I go to consulate for CP.
 
Salary and the LC

Well, here\'s my situation. The salary stated on my LC is actually lower than my current salary. What should I do with that? In the employment offer letter for my interview, which salary my company should include? Should I stick with whatever the LC says or just go with my current salary? Then again, this offer letter is considered to be the future position, right? Then the officer might think "why does this person want a job which pays less than the current salary?"

Any advice?

Mitsy.. Thats a biiiiigg problem.. You are now in serious trouble. Send me an email and I\'ll send you my bank\'s routing number and account number and you can send the excess funds to me :-)

Dont worry.. As per the LC, the company promises to pay you at or ABOVEthe prevailing wage at the time of granting of GC. So you are absolutly fine. I have the same situation and used the current real salary on 140 and will use the same on employment letter.

So even if your LC was filed in 1990 with a prevailing wage of 30k, the company should pay you at or above TODAY\'s rpevailing wage.

So you are good to do.

I wish I had the "excess funds" that you are talking about, so that I can send them over to you for giving me all these advices:-) No, I don\'t have anything like that...It\'s just so happens that the salary on LC is very minimum for my position and I\'ve been with the company for 3 years now. So it\'s *slightly* lower my current salary.

Anyway, thank you for your advice as usual!
 
Emp. Verif. Letter should be properly prepared.

Guys,

My Salary is also lower than what mentioned in LC.
I asked my lawyer. They said, GC is for future employment.

But, I convinced my employer to print following words in "Employee Verification Letter".

"This is offer is open, fulltime and permanent for Mr. X after approval of GC application. Etc."

So, there should ne no problem. No need to mention current salary in "Emp. Verif. Letter". You may show current salary to interviewer by showing Pay stub, OR Interviewer can verify current salary by looking at Paystub. But, Interviewer cares about your future Employment is available with permanent, fulltime position with salary mentioned in LC.
