Hello.

I am considering applying for H1B and H4 visa stamps in Vancouver. I have done it in my Country before, but this time I am thinking of trying in Canada because of money and time issue. I’ve heard a lot of not so happy experiences about it and would like to check if it is indeed safe and also how long it may take to get stamps.

My little backgrounds…
I am from South Korea and have a Master degree in the US.
I got my I-140 approved and this will be my third renewal.
I am married and will file for H1B and H4 together.

Any advice and experience sharing would be very appreciated.

Thank you.

I don't see why you won't be able to get your H-1B/H-4 visas revalidated as long as: you have maintained valid status during your entire stay in the U.S.; have not committed a crime that lead to arrest or deemed guilty in a court; or do not have a DUI record. Just remember when you go to Vancouver you are third country nationals (for them) and naturally they tend to look at your application with a magnifying glass.

If the consulate decides that you don't require an administrative processing and you don't have a PIMS issue, they still return your passport with a new visa next day or 2 days after the interview.

H1B Revalidation from Canada. Please suggest !!

--------------------------------------------------------------------------------

Hi,

I completed my 6 years H1 in Feb 08 and moved to EAD, which I got from last year (2007) July 140/485 filings. Since my labor approved in last July(2007) I had to wait till July 2008 to get new H1 one year extention filing and got approval in Oct 08 and Its been mentioed on H1 approval notice that I need to go to Consulate in Chennai to validate the Visa. ( I dont see I-94 at the bottom of visa). I am working for the same employer since last 3.5 years.I have my education from India.

Since my 140 is not approved, I would like to get back on h1 from EAD.

1)Can I go to canada and validate my h1 visa there?
2)If something goes wrong with H1, can I enter US back with my advanced parole and continue working on EAD?

Please suggest .........
