RRP and new Law

Hi All!

I am a landed immigrant and I am in USA on RRP that is expiring soon.( next month). I need to continue my stay here for some more months.

Do i need to go back to Canada to get it validated to show that I returned with in the RRP duration. ( I landed in 2000 so I will remain within the 3 year limit). I badly facing time crunch and would avoid making a trip if possible.


I called up Toronto CIC office and all they will say is "" after new law RRP is not valid. We will follow 3/2 rule""

Any suggestions??

Very interesting! It simply means that the new law is retroactive and its a good news.

As far as I understand, you don't need to go back before your RRP expires since its is no longer valid. You should be able to stay 3 more years in US after your RRP expiration date (or 3 years from June 28th '02 when RRP was invalidated?). Since they will count the RRP period against the 2 years that you needed to stay in Canada. Am I correct Ray?

I feel the same that I do not need to just for the sake of getting my RRP validated and that time spent on RRP will count as time I have spent in Canada.

But no consular( I have called 3-4 times) in CIC is ready to state it. May be they are still not sure how to handle this type of scenarios.!!!
 
you are right!

the laws are very confusing.

My guess is that I am on RRP for one year so it means I need to spend only 1 more year in Canada to make it 2 out of 5, starting from my date of landing.

what do you think?
 
Yes, I think the same...

So you should be able to live in US for 4 more years instead of 3 without losing your PR status
