Hi everybody. I got a problem that really pissed me off.
I am a GC holder (as6) from june 2007. I applied for RP in september 2007 and asked to expedite it. Sent all the forms, pictures and explanation letter. Received the receipt and than they asked me to send the pictures again. INS stated that i did not put them in the envelope(i am sure 100% that i did). I went to the walmart did the passport pictures and sent them again.
After multiple calls from me and local congressman office, after 6 months of promises that it is almost done and we about to send it, they denied the application.Reason: Blurry and unscannable photos.
In my believes they simply lost the application.
Any advice? Or just screw them and use national passport and green card.

I understand your concern. Please keep in mind that you have to be careful in using your national passport for travel and admission into the U.S. Since you're a formal asylee and got your residency approved through asylum. USCIS maintains a travel history for all applicant for admission into the U.S, and in review if they find out that you're using your national passport it might raise questions as to your initial claim of persecution. It is not a big issue, but I think you'll have to explain the reason to use your NP if required by USCIS. I know of someone that was harrassed consistently for renewing and using his NP at port of entry into the U.S. He had to request for FOIA with CBP (Customs and Border Protection) to know why he had to always go through secondary inspection and all that situation. When he finally rec'd the FOIA, it showed that USCIS has listed him as a subject for inspection in thier system. Although alot of the information was withheld based on non-disclosure but an officer left a comment in one of the inspection report section(Arrival/Departure Record) that he renewed his National Passport.

This is to say that each case is different but we always have to have caution. Mostly if USCIS has denied your RP. Just some words of advise, the discretion to use your NP is totally up to you and the circumstances at stake.

Use the NP + GC. Look you are a PR now and you are supposed to be using your NP + GC. with the current wait times for a RP/RTD, its advisable to use NP.

My national passport was issued after my backdated greencard. I am not going to my country of perssuation. I am going to the country were i dont need visa. Is it gonna help?
What do i do with INS. They charged me 300$ at the end of the day.
Should i file the appeal? If yes how long does it takes.

Now are you sure that the pics you sent were not from your digital camera and then printed out in Walmart photo printer?

I have known ppl doing that and being rejected by USCIS. Do you have the copy of pictures that they say are blurry? If the pics were taken profesinally, its impossible to believe that they were blurry or not clear.
 
Pictures were taken by Walmart and printed by walmart. I so the photos they were perfectly fine, as fine as the first two i sent them at the begining.

you can travel using GC AND NATIONAL PASSPORT,

i just came back from a trip to dubai and kuwait using my GC and national passport, i arrived at JFK , the immigration officer just asked me how long i was away from usa, i said only 2 weeks, he stamped my passport and said welcome back
