risk involved with CP

Hi,
My lawyer keeps telling me that there is a risk involved in going for CP as opposed to AOS. I would like to know if this is a significant risk? Also does anyone know what percentage of the applications( ones with all the papers in order) are rejected.

This info wud really help me decide

there is no specific % of people getting rejected in cp. As long as you have all the documents necessary, and there is no glitch in the security check and your company doesnt layoff you or file for bankruptcy, you would have a successful cp.
if u get rejected for lack of documents, you can come back to usa on NIV to get the necessary documents. if u get rejected for other reasons like fraud, then you cant come back to usa and the lawyers cannot help you as opposed to I485, where the lawyer can file for an appeal if there is any rejection.
Many lawyers are not familiar with CP and they dont know how to deal with it. Also, they dont make lot of money with CP opposed to I485; in fact, you dont need lawyer once you are done with I140.

I am not a lawyer and my knowledge is based on the postings from this forum and personal experience.
 
I concur with cannon's view that most attorneys are hesitant to recommend CP given their lack of familiarity with the process. My I-140 attorney was insisting that I pursue AOS. However, I realized that CP was a much wiser option for me (5 months vs. 2 or more years). Also the CP process is so streamlined - that you do not need an attorney - saving you $$$.

There does not seem to be any significant risk in CP. Ofcourse if the criteria underlying your immigrant petition change, i.e. company goes bankrupt, laid off etc.. - then that is a different story. Under I-485, there are ways around these issues but in CP you might get stuck.
