Spoke to my lawyer, who said that they are experiencing an almost 75% NOF rate. This is across the board.
He said that they respond to the NOF's in the 45 day period. Once they respond, the processing time is the same weather the case is NOFFed or not. The implication being that even though DOL is processing August-02, they are just assigning the cases to an analyst and/or NOF.
