I have an EB2 RIR filed with a PD of Dec 04 from California and am not sure which BEC is processing my case. What i am looking for is some opinion on weather:
1. It would be wise to file a PERM application now (might get a PD of May 06).
2. My lawyers would be willing to do this, however i was informed that if done so, I'd have withdraw my RIR. Is that true?
3. Is there any advantage of having a PERM labor certification along with an approved I-140 even if 485 cant be filed or is it just a futile effort and waste of money to go for PERM now?
With the retrogression in place along with the long BEC processing times, I am not sure if visa numbers would become available for Dec 04 before I have my labor certification. if they would, i'd just have to kick myself.
Any guidance would be appreciated!
