RIR to PERM

Yes, you can covert a RIR case to PERM. But there is a catch. Your priority date will be trasfered only if they determine that your RIR case and PERM case are IDENTICAL. The term identical is very broad. Atleast they should be identical in Job title, requirement, location etc.
Also, if the PERM case is denied then you loose your priority date.

In the caes that GC_dc said, you will retain ur priority date for RIR when u file PERM but that is conditional on the RIR and PERM applications being "identical". This is kinda subjective and this is where the risk lies. If the PERM app is denied, u lose the PD from ur RIR also!!!!!!!!!
Alternatively, you may apply a FRESH PERM application from the same campany provided the new application is "not identical" to the pending RIR application( different job title, etc). In this case both ur applications will be processed independently but the PERM application will have the new PD.

the company attorney, suggested that with same employee name and employer name - PERM filing will result in automatic withdrawal of old LC (mar 2004)application. This contradics what you suggested. Can you please provide
somekind of regulation (pdf) pointer, i will really appreciate. with this support
i can force them to switch to PERM

Only one LC filling
Guys, a recent PERM FAQ update indicates that as of August 31, 2005 employees cannot have more than one labor certification actively in process for the same alien at any given time. means if u have a case pending at BEC you may not be able to file
another one under PERM.
