RIR, posting for 6 months necessary ?

My company folks seem to think that before they can actually get the paperwork for the GC filed in, they would have to run ads for 6 months with a very specific ad description..

my lawyer on the other hand thinks that pattern of recruitment should be already there since the past 6 months and filing the RIR GC should only be a matter of posting 2-3 internet ads for a few weeks.

I have only abour 22 months left on my H1 - can someone please advise me on why i am getting such disparate views on GC filing and what seems more accurate?..

Also if i want to get an early PD, and be in the safest position what would be my best option? --> File nonRIR (regular) GC straight away (with limited ad posting requirements) -- OR --
go thru the RIR GC process even tho' it will take time..

Later would I be able to convert either of these to PERM ?. When is PERM expected?..

Your lawyer is right - to an extent. I am not sure, but I think just internet ADs do not cut it. You need to post it in a local news paper as well as in your company's notice board. Pattern of recruitment helps in RIR because that is what states that you are eligible for RIR.


Do not rely on PERM (also based on my understanding, it is not going to help nonRIR).
