RIR Paper ad responses...

I recently applied LC in Delaware SESA.

My attorney has mentioned in the LC application(under recruitment results) that my Employer received a total of four resumes and all of them are not matched with my skills that we mentioned in the paper ad & job descr.She also mentioned that none of those resumes are qualified to perform my job title.

Please advice: will SESA or DOL or INS convince with the above message?

Just to make you feel better, the recruitment ads for my position in the company has yielded over 20 responses... Company has rejected them some on the basis of insufficient technical skills or educational requirements..

But, if there is anyone who has witnessed a similar thing, would appreciate to hear from them...

It happens all the time. Some companies post very generic ads that would cover about every position in the company. They run these ads monthly in several newspapers and they get hundreds of applicants. As long as the applicant is really not qualified (for example, the job requires an MBA and the applicant is in his 4th year of study in a BS in physics) the applicant can be disqualified. It is also possible to state that there are multiple positions available and hire qualified US candidates.
 
So, it is very important to make Ad-s very specific, listing concrete technologies, languages, educatoinal requirements, etc? And not make them Generic (like "Company needs a Programmer").
 
Companys that do lots of GC processing for their employees do not want to go to the expense of placing hundreds of ads every month and keep track of what responses are for which ads. They run one very general ad and then explain to DOL why each candidate is not qualified. Sometimes there are more than a hundred candidates that need to be disqualified.
