RIR or Regular?

Currently, I am holding HIB working as a Junior Structural Engineer in our company doing bridge and facility building structural design. I have a MS degree on structural engineer. I have worked 15 month in this company. I had 3 year structal engineering experience outside US, but it is on buildings. The position I am in only requires a bachelor degree. I have couple questions really need your help.
(1) Somebody told me the 3 year experience I had outside US can not be counted because it is on building structures, but the building structure and bridge structure are almost the same. Actually, in our Professional Engineer License exam, we are required to be tested on both

(2) The position lawyer suggest me to post will be Senior Engineer, but in our company this position require at least 10 years experience, can I talk with my company to "creat" a position between the "Junior Structural Engineer" and "Senior Structural Engineer", like "Structural Engineer" requiring a MS degree and a Professional Engineer License (I got it last month :))

(3) Is there any way I can go for RIR EB2? and is there really big difference between EB2 and EB3 in the whole process?

1) I guess you can definitely use that 3 years outside US experience. Who knows what your experience is until you state it. When you get experience letter for that 3 years you should ask them to give it as you need it.

2)Lawyer probably suggesting because it may be safe to be a Senior position to defend you against "extrardinary ability" stuff w/ EB2. If they already did it, you should get your exp letters for what ever is going to be stated in RIR LC.

Getting rid of Jr. stuff looks good, if you can manage w/ your company.

3) When you use Masters for your GC, you are automatically EB2. And there is no difference between EB2/EB3 at present as priority dates are current for both.

For RIR, your company should run advertisements and other recruiting compaign for that position. If they haven't done it yet, you can word it to fit to your requirement...after discussing w/ your lawyer.

On top of it, your current employer experience will NOT count towards your GC. You can word it all as you want when you apply for LC (in comply w/ your earlier experience). You should be able to provide support docs for what ever you state in LC (during I-140/I-485) w/ Exp letters/Emloyment letters etc., You can fix it all if you have support of company and lawyer !!
