I am on H1B visa and 6 yrs is getting over next month. My labor cert was filed in June 2001 in CA and moved to DOL in Jan 2002. My employer has filed 7th year extension of H1B recently and yet to get approval on that.
Last week, I got a RFE from SWA on my labor cert. SWA has given 3 choices :
1. Run another ad and see whether any candidate is found here
2. Convert this to non-RIR category
3. Scrap the case.
My employer has selected the first one and is about to send the results. My emolyer didn't have any layoffs in my position in last one year. My questions are :
1. What's the probability that DOL will approve my case ?
2. If they don't approve, will they give another chance to convert this to non-RIR ? If they do, will they keep the same priority date (as June 2001) ?
3. If they conver this to non-RIR and don't keep the same priority date, will I be eligible for 7th year of H1B extension which I filed already ?
4. What's the probability of labor cert rejection at this stage ?
I will appreciate some expert comments on this. Thanks.
