RIR Labor Application in San Francisco

Hi guys,

My Labor was filed in RIR category in June 2002 and the SESA (San Francisco) is currently processing 5/29. So, my guess is that it'll move to DoL shortly. But after hearing so much about the rfe and RIR applications getting rejected, I've been thinking of having another application in non-RIR category, just in case. Is that possible? And if not, can anyone kindly tell me what other options I might have. FYI, my H1 has a little less than 3 years on it, at this point.

You can file 2 labor certificate applications from the same employer / same state.

SESA is working on June End now so your application will be with DOL soon, DOL is working on June 2002 cases now, so in 10-12 months you can get answer from DOL.

Your options are
- wait for DOL's answer & see what happens since you have 3 years remaining on your H1 & you can always get extension after 6 year quota if you have LC applied for then 1 year ago, so no problem there

- If your company has office in other states, check possibilities of applying from there

- Find a future employer in other state who can apply for your labor now & you can join with them after your Labor
 
Thanks a lot. Also, if I wait for DoL to reply back to me and if that's negative and I decide to go back to non-RIR, will the date of June 2002 in my case stay or will my application date chane to the date I actually transfer over to non-RIR?
