RIR Denial Worker Availability

Hi All,

I recd a letter from SF DOL stating that my petition under RIR is denied. It states that the application should be placed in queue for non-RIR applications based on the Local Office Priority Date.

Could you pls tell me whether is it as good as starting the whole process again with State and then Regional Labor Clearance? Or just starting Regional Labor again?

It is not as bad as starting new. It is same as starting in NON-RIR from the beginning itself. You keep your priority date and you will be able to extend H1 visa if your labor has been in the queue for 1 yr or more.

It is in State SWA now. Once it is cleared in State level, it will go to DOL again.
