I am currently employed by a Governmental Organization. My position was advertised five times before they found any suitable candidate for the job. I was selected as the most suitable candidate. My question is the following:
1) As my position was advertised in newspapers from June 2000 to March 2001
i.e, 5 times), can I still apply for labor certification under RIR;
2) The company is governmental organization, so they are not going to readvertise, as they already hired me in that position after many searching. Typically, in any governmnetal organization, they have to do requisition for a position that is left vacant. In my case the position is already filled so they cannot readvertise.
3) My organization is willing to sign all documents and provide a memorendum that was sent to the Director of Personnel why I should have more salary as I have requested (was granted).
4) Provide the list of resumes and candidate names that were interviewed for the process, but they are not going to disclose why the other candidate was not selected under a governmental confidentiality.
5) Will provide the advertisement cuttings that were done during the period (i.e., 5 times).
My question is do I qualify for RIR under the Department of Labor.
Please provide any suggestions.
