RIR case moved back to EDD

Hi all,

My case was filed on sept 9th of 2001 in RIR category. It cleared the EDD and got transferred to the DOL.

But now it got rejected from the DOL back to EDD as they are not processing any RIR cases.

Did anyone experience such a case?

I also heard that the new RIR cases are on hold for California?

Is there some way to bring back the case to RIR?

Any help would be appreciated.

I have myself run in to same situation like yours, Transfer from EDD to DOL and back.. Fortunately I could use concurrent filing to get over this problem. I know 3 other individuals in my company who ran into similar situation. These days since DOL gets lot of response to the ads and by that time the original labor date is more than 6 months old, it needs a re-advertisement and this causes delay and your company is asked to do a re-advertisement of your labor case and if they receive too many response for it, DOL transfers papers to EDD back and the whole thing gets delayed..
Try concurrent filing if that option is available to you.
 
I meant labor substitution with concurrent filing ! Just concurrent filing is not possible when labor is not approved !

How long did it take for your case to get approved again?

you cannot do anything with your existing labor to speed up. It will take its own course of time. If your company can find a terminated employee's already approved labor, it can be used for your filing I140 and I485 concurrently. Your labor processing will continue in background. It is just another approach to speed up your processing. This process of replacing another persons labor approval is called substitution process. You may find out more about substitution process by just typing in labor substitution in any immigration sites.
My lawyer advised me to go for labor substitution since my case was moved back to EDD from DOL. This is happening to many people that I have known.
