RIR approval issues

Hi Guys,
Does any one know what happens if a labor certification does not get approved through the RIR? Does it go back to the regular processing or do they throw out the entire application and you have to start a new one? I am depending on that for my H1B renewal.

ConcernedHi Guys,

These days, DOL is usually remanding back as regular LC, but DOL can outright deny applications too, all depends on the merits of the application.

Thats NOT "TRUE"
It totally depends on the "Profession" and "Petitioner". There is no legal justification for nullify and denial of the recruitment efforts right away. The attorneys are fighting back with successfull arguments and getting it clear in few days. Weak "petitioner" and "attorney" puts you in Trouble even if you have NIW merits..

DOL can deny applications, usually it will first issue RFEs, but it surely can deny applications without remanding them first.

Hi,
Based on the current discussion I like to know if anybody got approved after the case is remanded to SWA and asked to advertise again for 'one day' to test the 'market' and submit the recruitment results.

Thanks
